1. About These Terms

These Terms and Conditions ("Terms") govern all services, quotes, orders and contracts between Decorium Curtain Pty Ltd (ABN 18 685 892 586) trading as Decorium Curtains & Blinds ("Decorium", "we", "us") and you ("Customer", "you") in connection with the supply and installation of curtains, roller blinds and related window furnishing products ("Products").

By accepting a quote, paying a deposit, or otherwise instructing us to proceed with an order, you agree to be bound by these Terms. If you do not agree, do not proceed with an order.

These Terms are governed by the laws of the State of Victoria, Australia.

2. Quotes & Quote Validity

  • All quotes are valid for 30 days from the date of issue unless otherwise stated in writing.
  • Quotes issued based on customer-provided measurements or descriptions are estimates only. Final pricing is confirmed after our consultant completes an on-site measurement.
  • Decorium reserves the right to amend a quote after site inspection if actual measurements or site conditions differ from those assumed in the original estimate.
  • All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
  • Quotes are subject to fabric availability. If your selected fabric is discontinued or unavailable, we will contact you to discuss alternatives before proceeding.

3. Acceptance of Quote & Binding Agreement

A binding contract between you and Decorium is formed when:

  • You accept a quote in writing (including via email, SMS, WhatsApp, or the online customer portal), AND
  • You pay the required deposit.

Once a quote is accepted, you are bound by these Terms. By accepting a quote, you acknowledge that you have read, understood and agree to these Terms in full.

Online quote acceptance via the Decorium customer portal constitutes a legally binding agreement. Your acceptance is recorded with a timestamp and IP address as evidence of agreement.

4. Deposit & Payment Terms

  • Deposit: A deposit of 30% of the total quoted price (inc. GST) is required to confirm your order and commence production scheduling.
  • Balance payment: The remaining 70% balance is due on the day of installation, before our installers leave your property. Work will not be deemed complete until full payment is received.
  • Accepted payment methods: Bank transfer (BSB/Account provided on invoice), credit card, or cash. A surcharge of 1.5% applies to credit card payments.
  • Late payment: Balances unpaid for more than 7 days after installation may incur a late payment fee of 2% per month on the outstanding amount. Decorium reserves the right to pursue unpaid debts through appropriate legal channels, including the Victorian Civil and Administrative Tribunal (VCAT) or a debt collection agency.
  • Returned or dishonoured payments: A $35 fee applies to any returned or dishonoured payment.

5. Changes to Orders After Acceptance

Important: Orders cannot be changed without written approval from Decorium management.

  • Any request to change fabric, dimensions, heading style, mounting type or any other specification after quote acceptance must be submitted in writing to info@decoriumcurtain.com.au.
  • Decorium will assess the change request and advise whether it is possible and if any additional charges apply.
  • If fabric has already been ordered or cutting has commenced, changes may not be possible, and the customer remains liable for the original order cost.
  • Approved changes that increase the order value require additional payment before production recommences.
  • Decorium does not accept verbal change requests. All changes must be confirmed in writing by a Decorium manager to be valid.

6. Cancellation Policy

  • Cancellation before production commences: If you cancel within 48 hours of deposit payment and before fabric has been ordered, your deposit will be refunded in full less a $150 administrative fee.
  • Cancellation after fabric is ordered or production has commenced: Your deposit is non-refundable. You may also be liable for costs incurred by Decorium above the deposit amount, including fabric costs and labour already performed.
  • Change of mind: Decorium does not accept change of mind cancellations after production has commenced. All fabrics are custom-cut to your specific measurements and cannot be resold.
  • Decorium-initiated cancellations: If Decorium cancels your order (excluding force majeure events), a full refund of your deposit will be issued within 5 business days.

7. Measurements & Accuracy

  • Where Decorium conducts an on-site measurement, we take responsibility for measurement accuracy.
  • Where measurements are provided by the customer (including via photos, descriptions or self-measured dimensions), the customer takes responsibility for measurement accuracy. Decorium will not be liable for ill-fitting products resulting from customer-provided measurements.
  • Estimates provided prior to a site visit are indicative only. Final dimensions are confirmed at the site visit.
  • Slight variations in finished product size of ±2% are within acceptable manufacturing tolerances and do not constitute a defect.

8. Installation

  • The customer must ensure clear, safe access to all installation areas on the agreed installation date.
  • The customer is responsible for removing all furniture, wall hangings and other items that obstruct the installation area prior to our arrival.
  • Decorium is not responsible for pre-existing damage to walls, ceilings or window frames. Our installers will note any pre-existing damage before commencing work.
  • Minor wall anchoring (drill holes) is required for track installation. The customer acknowledges this and accepts it as part of the standard installation process.
  • If installation cannot be completed due to customer-caused access issues, a re-attendance fee of $150 may apply.

9. Warranty & Defects

  • Workmanship warranty: Decorium provides a 2-year warranty on all installation workmanship from the date of installation.
  • Fabric warranty: Fabric is covered by the manufacturer's warranty (typically 5 years for UV/fade resistance on premium Turkish fabrics). Warranty claims must be submitted with proof of purchase.
  • Exclusions: The warranty does not cover damage caused by misuse, improper care, excessive moisture, insects, pets, accidental damage, or modifications made by anyone other than Decorium.
  • Consumer guarantees: Nothing in these Terms excludes your rights under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2). If a product has a major failure, you are entitled to a replacement or refund.
  • To make a warranty claim, contact info@decoriumcurtain.com.au with photos and a description of the issue within the warranty period.

10. Limitation of Liability

  • To the maximum extent permitted by law, Decorium's total liability for any claim arising from our services is limited to the total amount paid by the customer for the specific order giving rise to the claim.
  • Decorium is not liable for indirect, consequential, special or incidental loss including loss of profits, loss of use, or property damage beyond the immediate scope of the order.
  • Nothing in this clause limits your rights under the Australian Consumer Law.

11. Disputes & Complaints

  • In the first instance, contact us directly at info@decoriumcurtain.com.au or 0477 343 885. We are committed to resolving disputes promptly and fairly.
  • If a resolution cannot be reached within 14 days, either party may escalate to Consumer Affairs Victoria or the Victorian Civil and Administrative Tribunal (VCAT).
  • These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia.

12. Privacy

We collect and handle your personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988. We do not sell your personal information to third parties.

13. Amendments

Decorium reserves the right to amend these Terms at any time. Updated Terms will be published on our website. Your continued engagement with Decorium after any update constitutes acceptance of the updated Terms. Orders already confirmed prior to any update will be governed by the Terms in effect at the time of acceptance.
